2. Agreement to Terms
These terms and conditions (“Terms”) govern your use of our services (the “Services”) relating to the Vibrant Energy Saving Audit (“VESA”).
You accept these Terms by signing up for, accessing and/or paying for the VESA.

The VESA can be accessed via our website.

Our Conduct

5. Standard of Service
We will provide the Services using reasonable skill and care.
We will make reasonable efforts to complete the work in a timely manner, although time is not of the essence.

6. Limitations of Inspection
Any surveys or inspections are limited to areas of the property that are reasonably accessible and visible. No destructive investigation, structural testing, or utility testing will be carried out.

7. Communication
All communication will be in English.
We may contact you via email or SMS using the contact details you provide.

Your Responsibilities

8. Eligibility
You must be at least 18 years old and a UK resident.

9. Accuracy of Information
You are responsible for providing true, accurate, and up-to-date information.

10. Access and Conduct
You must allow safe, unobstructed access for our operatives and treat them respectfully.
You must not infringe on our rights or those of others while using our Services.

Content and Use of the VESA

11. Third-Party Data
Some data used is sourced from third parties. We do not guarantee the accuracy or completeness of such information.

12. Nature of the VESA
The VESA is a guide for energy improvement and not a full building survey, valuation, or legal compliance report.
You should seek independent professional advice before making structural or legal decisions.

13. Recommendations
Recommendations are made using reasonable care and skill, but actual results may vary due to implementation, equipment performance, market conditions, and buyer preferences.

14. Assumptions & Inaccessibility
If areas are inaccessible, we will make reasonable assumptions.
Figures are based on information available at the time of report generation and will not be updated if external conditions change.

15. Assumptions About Property
a. We assume the property is structurally sound, safe to work on, and suitable for installing recommended improvements.
b. We assume you have or can obtain the legal rights/permissions required. We do not provide planning or legal advice.

Cancellation

16. Your Right to Cancel
You may cancel the VESA (with a full refund) prior to the appointment being arranged.
After an appointment is made, the service becomes bespoke and non-refundable.

17. Our Right to Suspend
We may suspend or stop work if you breach your responsibilities under these Terms.

Liability

18. Scope of Responsibility
We accept responsibility for foreseeable losses if we fail to comply with these Terms or use reasonable skill and care.

19. We are not responsible for:
a. Events beyond our reasonable control
b. Errors from third-party data or services
c. Your failure to secure your account
d. Any loss of profit, income, or sales
e. Faults in third-party goods/services installed based on our recommendations

20. Liability Cap
Our total liability is limited to twice the amount paid for the VESA, except where prohibited by law.

Intellectual Property

21. Ownership
All VESA content is owned by or licensed to us and protected by copyright laws.

22. Permitted Use
You may print or download one copy for personal use only.
You may not use any VESA content for commercial purposes without our written permission.

General Terms

23. Changes to Terms
We may update these Terms from time to time due to legal, technological, or business changes.

24. Transfer of Agreement
We may transfer our rights and obligations to another entity. Where legally required, we will notify you.

25. Consumer Rights
Nothing in these Terms affects your statutory consumer rights.
